Can I Sell My Home While in Foreclosure?

Yes. In most cases, homeowners can still sell their property while it is in foreclosure, provided the foreclosure sale has not yet occurred. Receiving foreclosure notices does not automatically transfer ownership of the property to the lender.

Many homeowners are surprised to learn that selling before foreclosure is completed may allow them to pay off their mortgage, avoid foreclosure on their record, and preserve any remaining equity in the home.

When a property is sold, the mortgage is typically paid off through the escrow process.  The escrow company uses the proceeds from the sale to satisfy the outstanding loan balance and any other liens or fees associated with the property.  Any remaining proceeds may belong to the homeowner, depending on their equity position.

Selling before foreclosure can provide greater control over the outcome and may help homeowners move forward on their own terms rather than allowing the property to be sold at auction.
